Michigan debuts toll-free child abuse call-in plan

LANSING— A new call-in system for reporting abuse and neglect debuts Monday in Michigan, another step toward compliance with a court-ordered mandate for the state to improve conditions for children needing protective services.

The new system establishes a single phone number statewide for reporting abuse or neglect related to children and adults. The number will be staffed around-the-clock, including weekends and holidays. Decisions on whether to investigate a child abuse case are expected to be made on the spot, no matter what time of day or night, before being directly referred to county-level child protective services staff.

The statewide complaint intake system will be based in Kent County, where a six-county pilot program testing the system has run since September. The statewide system replaces one where calls were made to individual Department of Human Services county-level offices, which sometimes led to inconsistent results.

“The virtue of having a statewide, centralized intake is that you have consistency in the standards that the state is applying on the law of abuse and neglect,” said Maura Corrigan, director of the Michigan Department of Human Services. “You don’t get local variations in standards.”

The new, toll-free phone number will be available to both the general public and those mandated by law to report suspected child abuse and neglect such as teachers and doctors.

The centralized system is likely to increase the number of child abuse complaints lodged with the state.

Corrigan, a former Supreme Court justice, has made complying with terms of a settlement related to child protective services and foster care a high priority since becoming the Department of Human Services director in early 2011. A whiteboard hanging in the DHS office notes several of the settlement goals and the agency’s progress toward meeting them.

The central call-in system goal will be met nearly two months ahead of the required compliance schedule.

A New York-based group called Children’s Rights sued in 2006 to force the state to make improvements in foster care and child protective services. A settlement agreement was reached in 2008, and modified last year to give the state some more flexibility in meeting requirements.

Michigan has hired hundreds of new workers to reduce caseloads in foster care and protective services. Ninety-five percent of foster care workers are required to have no more than 15 cases each by October 2013. Neglect workers shall have no more than 12 open investigations by the end of 2013.

There also are strict deadlines for medical assessments for each child. Michigan also is trying to recruit more foster parents.

CAPITAL MURDER CHARGE IN CHILD’S RUNNING DEATH

The grandmother accused of making nine-year-old Savannah Hardin runaround her house until she died could now face the death penalty.

Prosecutors announced Thursday that charges against Joyce Garrard will be upgraded from felony murder to capital murder. They said the charges against stepmother Jessica Hardin might also be upgraded, but no decision has been made on that.

Garrard and Hardin appeared in court Thursday to argue for a reduction of their $500,000 bond. The judge did not immediately rule on the matter, but prosecutors revealed some additional information about the case during the hearing, according to WBRC.

Garrard allegedly forced Savannah to run for hours until she collapsed and had a seizure as punishment for lying about eating a candy bar. Savannah died in a Birmingham, Alabama, hospital three days later.

In court Thursday, assistant district attorney Marcus Reid reportedly claimed that Garrard made the girl carry several pounds of firewood for part of the run. WBRC reported that he also said Savannah was crawling and vomiting before she collapsed.

Reid reportedly revealed that investigators have surveillance video of Garrard telling the school bus driver that “I am going to run her ’til she can’t run no more.”

A defense attorney told the judge the women have received death threats in jail, according to WGAD. The case could go before a grand jury as early as next week.

House panel approves bill for child fatality panel

FRANKFORT, Ky. – The House Health and Welfare Committee has given its approval to a bill that would create a panel of experts to review cases in which children are killed or seriously injured because of abuse or neglect.

Democratic state Rep. Susan Westrom of Lexington is pushing the legislation that requires the Kentucky Cabinet for Health and Family Services to provide staff and administrative assistance to the group.

The Courier-Journal, the Lexington Herald Leader and the Todd County Standard have been focusing attention on the issue of child abuse deaths, in part through a legal battle with the state over access to records.

Westrom’s bill, House Bill 200 , creates an 11-member panel — which would include legal, legislative, medical and law enforcement representatives — to review child deaths.

Milwaukee:Father convicted of beating infant daughter to death

Littleton Jackson, who last year beat his 11-month-old daughter to death, was convicted Thursday of first-degree intentional homicide.

The baby, Millie Smith, suffered horrific injuries.

Jackson, who told police he was drunk when he attacked Millie on Sept. 25, bit the child’s face and pummeled her. When Millie’s mother returned to the home she shared with Jackson, she found Millie on the floor, bruised, naked, with a broken rib, a swollen face and rectal bleeding.

She also found Jackson, shirtless, with what appeared to be blood around his neck.

The mother told police Jackson was crying and told her: “I think she’s going to die. She can’t breathe. I think I’m going to jail for the rest of my life.”

Jackson, 29, faces up to life in prison. A sentencing date has not been set.

Sloan Briles, the father who threw his 7-year-old son off a cruise boat into Newport Harbor, is scheduled to report to a rehab program by the end of the week.

The former marine, 35, pleaded guilty Monday to felony child abuse and resisting arrest in the Aug. 28 incident, reports CBS Los Angeles.

The Los Angeles Times reports Briles was sentenced to three years of probation, 180 days in a Veterans Administration residential treatment program and one year in treatment for child abuse.

Briles reportedly slapped his son while aboard a tour boat and tossed him into the harbor. Orange County Sheriff’s spokesman Him Amormino said the boy was crying about an argument between Briles and his father’s girlfriend before the incident occurred.

“Three boaters that were nearby came to the boy’s rescue,” said Amormino. “The father did eventually jump in, but by that time the boy was rescued by a boater.”

Both the boy and his brother were later returned to their mother’s care.

If Briles fails to complete the inpatient program, he will serve six months in Orange County Jail and receive no credit for time already spent in treatment.

“It’s an all or nothing deal,” said Deputy Dist. Atty. Cyril Yu, who said he was satisfied with the guilty plea but believed Briles deserved jail time.

“Certainly he was cognizant of what took place,” Yu said.

Briles was heavily intoxicated at the time of the incident, and his lawyer said he was hospitalized for alcohol withdrawal for two days after his arrest.

A mother of three was arrested and charged with three counts of child neglect Monday following anonymous complaints to the Florida Department of Children and Families ( DCF) and an investigation by the Port St. Lucie Police Department.

For the second time in a week, children have been removed from a home in St. Lucie County after investigators found filthy conditions inside.

From the outside, the home on Chapman Avenue in Port St. Lucie looks fine, but inside police say it was a different story. Officer Steven Brown was there and called it one of the most shocking cases in his nine years on the force.

“When I walked in, the smell was so overwhelming. I was in there for about 2 or 3 minutes just to observe everything, and holding my breath about half that time,” said Officer Brown.

There were dirty dishes with moldy food, bugs, and more than fifty piles of dog waste.

“The first thing I saw were several mattresses piled up. The stains were seeping over to the sides of the mattresses,” added Officer Brown.

The mother, 26-year-old Victoria Hinchcliff, was arrested and charged with three counts of child neglect involving her nine, six, and five-year-old children.

Just last week, a Fort Pierce couple was arrested for failing to properly care for their two, three, and four-year-olds.  In both cases, someone stepped forward to alert authorities. In the Hinchcliff case, it was a school teacher who noticed one of the children was coming to school dirty and not wearing any underwear.

Florida has the highest rate in the nation of children who die from abuse at the hands of their parents; that’s why organizations like CASTLE on the Treasure Coast are so important.

For more than three decades, CASTLE has worked to prevent child abuse by working with families free of charge to teach strong parenting skills, so children have safe and nurturing homes. Doug Borrie, CASTLE’s assistant executive director, says there are a number of reasons families get in these situations.

“It could be poverty, it could be failure to look for services, maybe a fear of approaching services, maybe shame,” said Borrie.

Borrie says what’s crucial is that if the family doesn’t step forward that someone else, a teacher, neighbor, or friend will.

“If you see something, say something. You may be the only thing between that child being hurt and not being hurt,” added Borrie.

2 boys, 10, accused of sex assault on Houston bus

 

HOUSTON, TEXAS

Houston police say two 10-year-old boys have been charged with sexually assaulting an 8-year-old boy on a school bus.

The boys were arrested last week after authorities reviewed a security videotape from the bus.

The alleged incident happened in August but the investigation took several months. Houston police spokesman Kese Smith said Tuesday it is not unusual for investigations involving juveniles to take that long.

Houston school district spokesman Jason Spencer says officials were first made aware of the alleged assault when the district’s transportation department was asked by a parent on Aug. 30 to review conditions on a bus that transports special needs students to an elementary school.

If convicted on charges of aggravated sexual assault of a child, they could face a sentence of up to 40 years.

Prevent Child Abuse West Virginia (PCAWV) sponsored a breakfast on Tuesday morning to talk about a piece of legislation that would increase funding for prevention when it comes to sexual abuse against children.

Organizers say they’re urging lawmakers to adopt the legislation in response to the recent child sexual abuse scandal at Penn State.

PCAWV is calling on lawmakers to adopt a bill that would increase funding for prevention programs and training, as well as expanded requirements for reporting suspected abuse and increase penalties for failing to report abuse.

The legislation proposed would increase the penalty for failing to report from $100 to $1,000. Right now, a person convicted of this crime also faces 10 days in jail.

The proposed law would include anyone who deals with children, including teachers, youth camp counselors, coaches and medical and religious personnel.

Jetta Bernier was the keynote speaker at Tuesday’s breakfast. She is a national expert on policies to prevent child sexual abuse. She also directs the Enough Abuse Campaign initiative out of Massachusetts to prevent child sexual abuse.

Governor, lawmakers name child abuse study panel

HARRISBURG, PENNSYLVANIA

Lawyers and experts on child abuse were among those named Tuesday to a new panel established to study Pennsylvania’s child abuse laws and propose changes.

Legislative leaders and Gov. Tom Corbett announced their appointments to the Task Force on Child Protection, which has until the end of November to issue findings and recommendations.

Bucks County District Attorney David Heckler, a former state legislator and former county judge, will serve as chairman.

Other members include a children’s hospital physician, a social worker, a prosecutor and the chief executive of the Pennsylvania Coalition Against Rape. A state police lieutenant in the criminal investigations bureau will aid the group, and Public Welfare Secretary Gary Alexander will serve in an ex-officio capacity.

The task force will study how child abuse is reported and responded to; collect input from the public; and report how procedures, laws and training can be improved.

The House and Senate set up the task force in response to the child sex-abuse scandal in which former Penn State assistant football coach Jerry Sandusky is accused of molesting 10 boys over a 15-year period. Sandusky is out on bail while awaiting trial; he has denied the allegations against him.

Man arrested on suspected child abuse in Tucson

TUCSON (AP)
Authorities say a man has been arrested on suspicion of child abuse in Tucson.

The U.S. Marshals Service located 28-year-old Leonard Dorame on Monday at a Tucson residence. He’s been booked into the Pima County Jail.

Tucson police say officers responded to a hospital on Oct. 25 in response to a report of a child that had severe injuries that appeared to be non-accidental in nature.

They say a 4-month old boy had numerous fractures all over his body, with every one of his limbs having multiple breaks in addition to other injuries. I

Authorities say Dorame is the child’s father. He allegedly was caring for the baby while the mother was at work.

They say the fractures were discovered after the mother took the baby for a doctor’s appointment.

AMERICA’S IGNORED EPIDEMIC….CHILD AND SEXUAL ABUSE.

As Americans we have so much to be proud of as we are the greatest nation in the world.

As Americans we fight for liberty and the pursuit of happiness.

As Americans we are humanitarians, we are the first to step up to the plate and come to the aide of a Nation in peril.

As Americans we fight against the injustices of the world.

As Americans we stand up against those who impose dictatorship.

As Americans we do not tolerate oppression or genocide.

However, As Americans… What are we doing for our children here on the home front?

While America stands up for the rights of those outside our borders we find it incredibly disheartening that our citizens are pushing for common sense laws that should have already been in place right here in the United States.   It is apparent that our Nation steps up to the plate for our own children after a tragedy have occurred.  After a child has been ripped of their innocence, demoralized, violated beyond our emotional comprehension and in many cases… murdered.

In light of the Penn State and Syracuse molestation charges and a subculture that protected the child abusers Jerry Sandusky and Bernie Fine we now have a few state legislators asking how this occurred.

Let’s reflect backwards on history to answer this question…..

For starters we live in a culture where children do not benefit from our equal rights and protection laws. Our culture firmly believes corporal punishment of our children is acceptable and it is lawful in each state of the union.  This law protects a parent who believes hitting their child is acceptable. This is not a discussion about “light” spanking; on the contrary this is about hitting your child with great force when angry.

Secondly, our culture has adopted the practice to turn away when a child is being abused.  Turn up the television to avoid listening to the child’s screams and pleas for help; turn off the television when the news covers a story on child abuse. Our culture simply says, “It is not my problem!”  Our culture, as proven at Penn State and Syracuse, stays quiet for the right price and for the reputation of a lucrative enterprise.  Our children are stripped of their integrity and dignity, and are placed last at the expense of community and wellbeing.

In last weeks news, a 7 year young girl named Jorelys Rivera was raped, beaten, stabbed to death, and thrown into a dumpster. The young man charged with her brutal murder is 20 year young.  Ryan Brunn obtained employment recently at the victim’s apartment complex.  There are no words in the English language to equate to us Jorelys final moments involved other than sheer horror.  To attempt to imagine is impossible.  When this highly calculated murder was completed, Jorelys was thrown into a dumpster like a piece of trash.  It was the murderer, Ryan Brunn’s way of expressing to the world that Jorelys   7 years of life had no meaning, no significance, and no relevance.

The horrific occurrence of violent child murder has become far too common in the United States.  Five children per day are murdered from child abuse and 1 in 5 girls, and 1 in 7 boys will have been sexually violated by the time they reach 18 years of age. These crimes will increase with time as long as our culture continues to deem children insignificant or less important.

Some of our citizens and some government representatives argue that it is too costly to incarcerate for life the child murders, molesters, and child abusers as well as the cost of investigation and forensics to prove ones guilt.

There are partial solutions to our ongoing epidemic and they are EDUCATION, AWARENESS, and ACCOUNTABILITY.

We as Americans must educate our children, parents, care givers, teachers, coaches and anyone who is involved with children in any way, shape or form.  We must provide children with the essential tools they need to understand abuse and where to report abuse.  These resources must be readily available for children of EVERY age.

We as Americans must incorporate Child Physical and Sexual Abuse into our school districts starting with the pre kindergarten level.  When a child begins learning this awareness in middle school it is already too late!   It is essential that we begin teaching “appropriate and inappropriate touch” at a much earlier age to protect and empower ALL of our children.

By empowering and educating our children we have the ability to actually save money in our nation. 33% of incarcerated people have been sexually violated, more than half of drug users and alcoholics have been abused.  There are over 60 million sex abuse survivors and sadly with the current attitude toward our children this number is growing.

Common Sense laws must be put into place in order to incarcerate for life; child molesters, child killers and child abusers. To date, abusers on every level are treated better than any other criminal. There is a belief that molesting a child is a victimless crime that a child will “get over it”.  This is a fallacy, an abused child does not heal with time, they hurt worse, they experience PTSD, and their lives have been forever altered for the worse.

The Nixzmary Brown Law Nationwide holds every abuser to accountability. The law places children on the forefront and puts children and community first…one strike and the abuser is incarcerated for life without parole, eliminating the chance to violate yet another child.   Jessica’s Law, Meghan’s Law, Amber’s Law, Dominick’s Law and the like, are examples of laws that protect society from what is truly the worst criminal act.  We have watched as lawmakers negotiate down Common Sense laws because they want to avoid “offending the offender” and impede upon their civil rights.  Our constitution states we have the right to live without harm and fear, yet children and parents are at risk of having their child’s rights or life taken by a criminal who is put first. We must put the safety and wellbeing of the community first, not the abusers.

Child abuse is our nations ignored and silenced epidemic.  It is our worst quality.  It is something we should all be ashamed of.  In all reality, according to who we are as a nation, this is Anti- American.  As true Americans, we must act now please.

Agency’s Report Details Events Leading To OKC Toddler’s Death

Nathan S. Maddox, of Jupiter, into custody on Oct. 7 from his sister’s home in Port. St. Lucie for the second-degree murder of his weeks-old daughter. He was booked into the St. Lucie County Jail, and was transferred Thursday to Palm Beach County.

Detectives from the Montgomery County Police continue to look for an 11 year-old boy after his mother was found dead, on Wednesday.

Jason Ausmus and his wife Misty both face charges in the case after bringing their twin babies to the hospital due to “breathing problems.” According to investigators, doctors found broken ribs and an adult hand print around the neck of one of the children.

Police detectives were trying to determine Thursday why a 6-week-old infant was buried in the Angeles National Forest and why the child’s death was not reported to authorities.
