Nixzmary Brown was born on July 18, 1998 in Waterbury, Connecticut. Even at birth Nixzmary was very beautiful as she graced us with her big brown eyes and a smile that would light up a room. She was a very healthy looking child who shared and cared greatly for her family and things around her. Nixzmary was raised bi-lingual, speaking English and Spanish.
Nixzmary’s mother Nixzaliz Santiago is from Puerto Rico and her biological father is a Pakistan man, Abdurrahman Mian. When Nixzaliz became pregnant of Nixzmary, Abdurrahman did not want her to have the baby, but Nixzaliz refused to listen to her partner as she wanted to have her baby. During Nixzaliz’s pregnancy the two split up and Nixzaliz moved to Connecticut and partnered up with Edward Brown. At a news conference Edward Brown advised he gave Nixzmary his surname, hence Nixzmary Brown. Sadly, Nixzaliz and Edward did not marry or remain in a relationship, although Nixzaliz gave birth to two of Edwards children, Edward and Selena.
Although Nixzmary was born in Connecticut, she spent several years in Nixzaliz’s hometown in Puerto Rico. Nixzaliz then moved the family to Brooklyn, New York in 2003 were she met Cesar Rodriguez. Cesar Rodriguez was always violent and many were made aware of this. Cesar was discharged from the Army for sending a young person pornographic pictures of himself. Prior to Nixzaliz and Cesar meeting in 2003, Cesar continued a life of abuse, criminality, and anger to each person in his life.
During Cesar’s and Nixzaliz’s relationship Cesar beat and molested Nixzaliz’s children, but most of his anger and rage was placed against Nixzmary. According to social workers, Nixzmary was the target child. Cesar would beat Nixzmary daily and molest her all the time. The daily beatings became increasingly worse requiring medical attention on a couple of occasions, that is, the times Cesar would allow Nixzmary to go to the hospital for treatment.
The Administration of Child Services were made aware of the abuse as complaints about the Brown’s family were reported . The first complaint which came in 2004 had proved unsubstantiated. The second complaint came on December 1, 2004 when Brown showed up at school with a black eye. Sadly, the neglect on ACS’s end contributed to Nixzmary’s demise.
It was reported that Nixzmary endured months of physical abuse on a daily basis. She was tied to a wooden chair while bungy cord was tied around her ankles and waste to keep Nixzmary captive to the chair. The chair was chained to the radiator causing Nixzmary to burn. Cesar would place duct tape over Nixzmary’s mouth so when he punched her with a closed fist her cries would be muted.
Cesar found pleasure in disrobing Nixzmary to the point of her being naked and he would whip/beat her with a belt and metal belt buckle. Cesar was savage and brutal when dealing with Nixzmary and Nixzaliz (Nixzmary’s mother) would do little or nothing to stop Cesar from beating her daughter.
Cesar, in his videotaped confession, stated that on January 11, 2006 Nixzmary had “stolen” a cup of Jello strawberry yogurt and jammed Cesar’s printer. Therefore, he stated he became enraged. Once again Cesar tortured Nixzmary as he bound her, beat her, then stripped her naked, and beat her with a belt. Then he forced Nixzmary into the bathroom tub and shoved her head under freezing cold water on a very cold January night. He would then slam her head into the bathtub causing the fatal blow that would kill Nixzmary. Her mother, Nixzaliz Santiago, ignored Rodriguez slamming Nixzmary’s head into a bathtub while dousing her with cold water.
Finally, when Nixzaliz checked on Nixzmary, 2 hours later, Nixzaliz gave Nixzmary a warm bath as she was freezing. After the bath, Nixzaliz clothed Nixzmary and put her down. As Nixzaliz exited the room, Nixzmary called to her stating “Mommy Mommy don’t leave me”, but Nixzaliz left Nixzmary alone to die alone. When Nixzaliz was asked by police “Did you think you would lose your daughter? Nixzaliz stated “Yes”.” That night around 4:00 a.m. Nixzmary’s older brother, Javier reported to her mother that Nixzmary was no longer moaning or breathing.
Nixzaliz ran into the room and beautiful Nixzmary was dead. Cesar would perform CPR on Nixzmary, while Nixzaliz ran upstairs to her neighbors house asking her for help. When her neighbor Ulbis Rivera entered the room where Nixzmary was she was in sheer shock as Nixzmary had bruises that covered her entire body, blood all over, and Nixzmary’s face was unrecognizable.
Since Nixzaliz and Cesar did not have a phone Ulbis (Neighbor) used her cell phone to call 911, and once Ulbis called 911, Nixzaliz started to scream and cry out “my daughter my daughter.” Prior to the phone call being made, Nixzaliz was not crying or screaming.
Almost two years after Cesar murdered Nixzmary his trial went underway. Cesar was acquitted of 2nd degree murder and was found guilty of 1st degree manslaughter. He received 29 years for brutally murdering beautiful, 7 year young, Nixzmary Brown.
Nixzaliz’s trial went under way after Cesar’s and Nixzaliz was found guilty of 1st degree manslaughter and she received 43 years in prison.
Nixzmary Brown’s murder caused Mayor Bloomberg to have the appropriate channels revamp ACS. Additionally, on October 9, 2009, Governor Paterson has signed into New York State Law “Nixzmary’s Law”. The signed bills include A.5080 / S.6091 – often referred to as “Nixzmary’s Law” – which amends the murder statute to add a new subsection addressing the murder of a child less than 14 in an “especially cruel and wanton manner” and authorizing a sentence of life without parole. Nixzmary Brown was seven years old when her mother and stepfather kept her tied to a chair in a “punishment room” over several days and then beat her to death. Now, individuals who commit such heinous acts may be sentenced to life in prison without the possibility of parole.
“Signing Nixzmary’s Law cannot bring back the life of a young girl, but it does send a message that such abuse of children will not go unpunished,” Governor Paterson said. “It is my sincere hope that a law such as this and continued vigilance by our law enforcement officials will help prevent tragedies like this from happening again.”
On a personal note, having attended both trials, verdicts, and sentencing (when I could take off of work) the pictures of Nixzmary’s dead body covered with bruises, blood, cuts, and gashes still haunt me.
It is because of the tragic and brutal murder of Nixzmary Brown that I started our organization, it was then that I decided I would do everything in my power to protect children.
May Nixzmary always be remembered and may her death not be in vain. Together we can make a difference!

To have a mother stand by and watch her baby get beat and molested and tortured and do nothing, is beyond my comprehension, but sadly, it happens every single day. Where were all these people???–The teachers, the neighbors, cps, and anyone else who saw bruises on this child. My God, how could they see this and not say anything or do anything to help this precious little angel???

For many years, I had no hope for a better future. I thought I would never grow up, that I would always live in a world of pain and hate. You see, I was a battered and abused child. I was placed into two foster homes and later returned to my parents. I almost lost the chance to grow up. At the age of two, I was admitted to a hospital–malnourished, battered, almost dead. I later wished that I was dead. I was placed on top of a hot stove, choked with a rope around my neck, beaten two to four times almost every day. Children’s Services cuts panned by critics as ‘playing with fire’

Abused children’s advocates blasted city officials Monday for slashing funding for child protective services amid the city budget crunch.
City Council members and parents accused Administration for Children’s Services officials of risking more child death horrors by cutting 17% of the workers who monitor the most vulnerable kids.
“You’re playing with fire here,” said Council General Welfare Committee Chairman Bill de Blasio (D-Brooklyn). “How can you possibly get the work done?”
Commissioner John Mattingly defended the cuts and said that the agency would be able to adequately protect the city’s children.
“I believe that we have, and I believe that we will,” he told a packed chamber.
The agency had to make deep cuts to close a $62 million budget gap and also make an additional 7% across-the-board cut ordered by Mayor Bloomberg.
More than 550 employees will be laid off and an additional 360 vacancies left unfilled in child protective services. That’s a cut of about 920 staff in an agency that employs about 7,000 people.
Parents, advocates and social workers waved signs that read “Lies” throughout Mattingly’s testimony, especially when he claimed that caseloads would remain at about 12 families per caseworker.
The advocates say the agency will go back to its understaffed days before the horrifying murder of 7-year-old Nixzmary Brown at the hands of her stepfather in 2006.
“They looked at the system and said this is what’s necessary to prevent that from happening again,” said Jennifer Marino Rojas of the Children’s Defense Fund. “Now they’re cutting back.”

An alarming 49 children who died under suspicious circumstances last year had been under the supervision of city child welfare workers, a new report shows.
That’s the highest number in two decades and more than twice the number reported in 2003, when 24 children known to the Administration for Children’s Services died.
The number conjures chilling images of children like Nixzmary Brown, whose violent death in 2006 at the hands of her stepfather could have been prevented if abuse complaints had been investigated.
Some critics warn that the figure shows abuse and neglect slipping through the cracks, but experts counter that these numbers could be the natural consequences of greater vigilance by the public and better reporting of abuse.
“I would not draw what seems to be the immediate conclusion, which is that ACS is failing,” said Andrew White, director of the Center for New York City Affairs at the New School and whose Child Welfare Watch report published the statistic this week. “We don’t know. The number covers too many types of cases.”
ACS attributes the high number of deaths to unprecedented abuse reports since Nixzmary’s high-profile murder.
The agency received 60,170 abuse complaints last year – a number second only to 2006 when 63,496 complaints set a three-decade record.
That’s compared with 47,640 complaints in 2005.
That means more kids are on ACS’ radar and people are more likely to report deaths as suspicious when they may not have raised flags previously.
If the child had a family member who had been accused of abuse even 10 years ago that death would be counted.
“When all abuse and neglect reports go up in general, these reports of suspicious child deaths go up,” ACS Commissioner John Mattingly said. “While every single death is a tragedy we work to prevent whenever possible, the indicator we watch most closely is the number of confirmed homicides of children by their caregivers.”
Of the 49 deaths last year, 14 were ruled homicides.
Richard Wexler of the National Coalition for Child Protection Reform said even deaths not ruled homicides can reflect neglect – and he blames a system too distracted by trivial abuse complaints to address serious problems.
The Daily News reviewed records of recent deaths and found several where neglect was a factor, including an infant who died after her mother ignored a medical condition and a kid felled by an asthma attack when no parents were home.

Advocates Fear City Budget Cuts Will Put Children at Risk

The threat of more than $83 million in budget cuts at New York City’s child-welfare agency has left advocates for children afraid that recent improvements in its operations, including reduced caseloads, could be threatened.
To bring the agency’s budget down to the size that Mayor Michael R. Bloomberg has requested, officials at the Administration for Children’s Services have prepared to reduce preventive services, institute a 5 percent cut in fees to foster-care agencies that hold contracts with the city and lay off more than 550 of its more than 6,800 employees.
The cuts would be the largest since John B. Mattingly became commissioner of the agency in 2004, and among the most severe reductions since it was created as a stand-alone department in 1996. The city, meanwhile, is receiving a steadily increasing number of reports of abuse and neglect — 65,856 in 2008, up from 63,434 the year before.
“As the economic crisis worsens, there are probably going to be more families who need services,” said Stephanie Gendell, an associate executive director of the Citizens’ Committee for Children of New York, an advocacy group. “It’s not like A.C.S. has become less busy.”
Jennifer Marino Rojas, the deputy director of the Children’s Defense Fund-New York and a former associate commissioner at the Administration for Children’s Services, said the cuts could not come at a worse moment. “A.C.S. was just getting the resources it needed to better respond to the needs of children and families,” she said.
“And now to start chipping away at that again really does threaten the stability of the agency.”
Perhaps the biggest fear is that the average caseload could balloon, after an intense effort to bring it to its current level, just under 12, from 21 three years ago. A children’s services spokeswoman, Sharman Stein, said she could not say that child-protective workers, who investigate reports of abuse and neglect, would be spared from layoffs; Marc La Vorgna, a spokesman for Mr. Bloomberg, said, “It’s an issue we have to look at very carefully.”
“We have a goal of reducing costs while continuing the progress made in reducing caseloads,” Mr. La Vorgna said.
In a statement sent by e-mail, Mr. Mattingly said he would try to keep caseloads at the current levels.
“These manageable caseloads are a critical element in our ability to do strong, thorough protective investigations,” he said. “Children’s services has committed to the children and families of this city that we will continue to strengthen and improve our child-protective work.” The city budget process is still underway; Mr. Bloomberg is scheduled to present his proposal on Friday.
The Administration for Children’s Services was founded in 1996, after the much-publicized beating death of 6-year-old Elisa Izquierdo, who was killed by her mother. In response to the public outcry, Mayor Rudolph W. Giuliani removed child-welfare programs from the Human Resources Administration, then the umbrella agency for all city social services, and promised a renewed focus on protecting children.
After a string of high-profile deaths of children in 2006 — including that of 7-year-old Nixzmary Brown, who was found abused and starved in her home — Mr. Mattingly instituted a series of changes, beefing up child-protective services, vastly increasing the amount of money spent on family support programs, reducing caseloads and shifting more responsibility to foster-care agencies.
But if Mr. Mattingly plans to prioritize child-protective caseloads, the proposed budget cuts would eliminate some preventive services and reduce others. These programs, which are administered through contracted agencies, address problems in families through parenting classes, housing advocacy or domestic violence counseling, for example, and can often keep children with their parents and out of foster care. Officials from the 36 foster-care agencies that hold contracts with the city have been told to prepare for a 5 percent cut in their fees, a reduction that many agency directors said could be devastating.
James F. Purcell, chief executive officer of the Council of Family and Child Caring Agencies, said that if there was less money to work with, “kids are going to stay in foster care even longer, and they’re already in care a very long time.” Jeremy Kohomban, the president and chief executive of Children’s Village, said he was planning to lay off several employees. Bill Baccaglini, the executive director of the New York Foundling, one of the city’s oldest and largest foster-care agencies, said the cuts would mean a loss of roughly $500,000.
According to data compiled in Child Welfare Watch, a biannual report published by the Center for New York City Affairs at the New School, preventive programs were operating at full capacity through most of 2008.
“A.C.S. is relying a lot more heavily on preventive services than it did, say, six years ago, and this means the caseloads are probably going to go up,” said Andrew White, the director of the center. “And it means there won’t be the kind of growth in family and children’s services that we need to diffuse the kinds of crises that send kids into foster care.”
Some of the layoffs within the city agency itself appear to be in line with Mr. Mattingly’s goals under Improved Outcomes for Children, an initiative begun in 2007 to delegate more responsibility and decision-making to the outside foster-care agencies. Several directors of the agencies said they were not concerned that many of the city positions would be eliminated.
But many of the proposed cuts are of positions that provide support to child-protective workers, like administrative staff, computer technicians and drivers.
In 2006, the agency began building a staff of 60 former police detectives who work as investigative consultants. Ten of those positions will be cut.
“The burden will fall on the child-protective workers, because they won’t have the supports that help them manage the cases and move the cases along,” said Faye Moore, president of the Social Service Employees Union.
Some advocates predicted that the budget cuts were only the beginning. Even if the economy begins to recover, they said, another round of reductions was possible in the fall.
“We finally started to get it right after Nixzmary Brown,” said Bill de Blasio, a city councilman from Brooklyn who is chairman of the General Welfare Committee. “Now, by definition, it will be much harder to keep up with the cases, it’ll be much harder to protect kids, and this level of cut at a single agency suggests that we are not making this agency a priority.”

I WANT TO BRING AWARENESS TO CHILD ABUSE IN THIS COUNTRY. I SEEN HOW MUCH YOU SUFFERED HERE ON THIS EARTH IN THE SHORT 7 YEARS YOU WERE HERE BUT I KNOW NOW YOUR AT PEACE. Almighty and Eternal God, Give me, I beseech You, the great gift of inward peace. Command the winds and storms of my unruly passions. Just wanted to say Happy Birthday to you, Nixzmary. It is hard to believe that so much time has passed since you left us so young. Today you would have been 13 years old, a teenager! I bet you would have been a beautiful young lady as you were a beautiful child. I think about you all the time and pray that you are happy in heaven with no more pain and suffering – only joy and love. I will bring you flowers today. I hope somehow you can enjoy them. God bless you and may there be a big party in Heaven for you today.
